You Need Insurance Before the Court Approves Your Permit

You cannot get a Georgia Limited Driving Permit without active auto insurance — and for DUI, uninsured motorist, and most other suspension categories, that insurance must include an SR-22 certificate filed with the Georgia Department of Driver Services. The court will not approve your petition until you show proof of coverage. Many drivers apply for the permit assuming they can buy insurance after approval. Georgia does not work that way.

The Limited Driving Permit is issued by a Superior Court judge, not by DDS. But DDS maintains the SR-22 filing record, and the court checks that record before granting the permit. This dual-authority structure creates confusion: you petition the court, but your insurance filing goes to DDS, and both agencies must confirm compliance before you can legally drive under the permit.

The court will not approve your petition until you show proof of SR-22 coverage — insurance comes first, permit approval second.

Georgia Reinstatement Fee

$200

This is the base reinstatement fee for uninsured motorist suspensions. DUI and habitual violator reinstatements carry different, often higher, fee structures set by DDS and the courts.

SR-22 Filing Is Required for Most Limited Driving Permit Categories

Georgia requires SR-22 proof of financial responsibility for virtually all Limited Driving Permit applicants. If your suspension stems from DUI, driving without insurance, reckless driving, habitual traffic offenses, or accumulation of points, you must obtain SR-22 insurance and have your carrier electronically file the SR-22 certificate with DDS before the court will consider your petition. The SR-22 proves you carry at least the state minimum liability coverage: $25,000 per person for bodily injury, $50,000 per accident, and $25,000 for property damage.

If you do not own a vehicle, you still need insurance. Non-owner SR-22 policies cover you when driving a borrowed or rented vehicle and satisfy the DDS filing requirement. Many suspended drivers assume they are exempt from insurance while suspended — Georgia law does not allow that exemption for Limited Driving Permit applicants.

HB 205, effective July 1, 2024, introduced the Ignition Interlock Limited Driving Permit pathway for DUI arrestees. This reform allows drivers to install an ignition interlock device and obtain a permit immediately after arrest, bypassing the traditional administrative license suspension process. The IID permit still requires SR-22 insurance, but it eliminates the hard suspension period for drivers who elect this option.

You cannot buy SR-22 insurance after the court approves your permit. The court requires proof of active SR-22 filing as part of the petition — insurance comes first, petition approval second.

What the Limited Driving Permit Actually Allows

The court defines your driving restrictions when it approves your petition. Georgia does not use a statewide template — each judge sets the permitted purposes and hours based on your documented need.

The most common permitted purposes are work, school, medical appointments, court-ordered programs like DUI education, and care for dependents. You must provide specific documentation: an employer letter on company letterhead stating your work schedule and location, a school enrollment letter, medical appointment records, or court program schedules. The judge will not approve vague requests. Your permit will list the exact locations you are allowed to drive to, the days of the week, and the time windows.

Violating your permit restrictions triggers immediate revocation and potential criminal charges for driving on a suspended license. If the court approved you to drive Monday through Friday from 7 a.m. to 6 p.m. for work purposes only, driving to a grocery store on Saturday is a violation — even if you have valid SR-22 insurance. The permit is not a restricted license in the general sense; it is a court order with narrow boundaries.

The Court Application Process and What It Costs

You petition the Superior Court in the county where you were convicted or where you reside. The court requires a written petition explaining why you need driving privileges, documentation proving your need, proof of SR-22 insurance filed with DDS, and payment of any outstanding fines or fees related to your suspension. Courts charge a filing fee that varies by county, typically in the range of $100 to $200, but this is not a statewide standard — call the clerk's office to confirm the exact amount.

Processing time depends on the court's docket. Some counties schedule hearings within two to three weeks; others take 45 days or longer. You cannot drive under the permit until the judge signs the order and you receive the physical permit document. The permit is a paper document, not a replacement driver's license card. You must carry it with you whenever you drive, along with your suspended license and proof of SR-22 insurance.

If your suspension was for unpaid fines or failure to appear in court, Georgia does not issue Limited Driving Permits until those matters are resolved. The court will deny your petition if DDS records show unresolved administrative holds.

SR-22 Maintenance Period After Reinstatement

3 years

For uninsured motorist suspensions, Georgia requires you to maintain continuous SR-22 filing for three years after your license is reinstated. Letting the SR-22 lapse triggers automatic re-suspension by DDS.

Finding a Carrier That Writes SR-22 for Suspended Drivers

Not all carriers write policies for suspended drivers. Standard-market insurers — the carriers you see advertised nationally — often decline SR-22 applications or require you to call rather than quote online. Non-standard carriers specialize in high-risk drivers and file SR-22 certificates as part of their core business. Georgia non-standard carriers include Acceptance Insurance, Bristol West, Dairyland, Direct Auto, GAINSCO, Geico (which writes both standard and non-standard tiers), Infinity, Kemper, National General, Progressive, The General, and USAA for eligible military members.

Monthly premiums for SR-22 insurance vary widely by your violation history, age, county, and coverage selections. The SR-22 filing itself is a small one-time fee charged by the carrier, typically under $50, but the underlying policy premium reflects your risk profile. Non-owner SR-22 policies cost less than owner policies because they do not cover a specific vehicle — expect monthly premiums in a lower range than if you were insuring a car you own.

Compare Carriers That Write Your Suspension Category

Georgia's dual-authority structure means you need SR-22 insurance that satisfies DDS electronic filing requirements and documentation that satisfies the court's petition review. Start by requesting quotes from carriers that explicitly write SR-22 policies in Georgia and confirm they can file electronically with DDS. Compare monthly premiums, but also confirm the carrier's filing process — some carriers submit SR-22 certificates within 24 hours, others take several business days, and you cannot submit your court petition until the filing shows active in the DDS system.

If you do not currently own a vehicle, specify non-owner SR-22 when requesting quotes. If you plan to purchase a vehicle after obtaining the permit, you will need to convert the non-owner policy to an owner policy and update the SR-22 filing — that conversion must happen before you take possession of the vehicle, not after. Use the carrier comparison tool to identify which Georgia non-standard insurers write your specific suspension category and compare their monthly rates side by side.
